These Terms and Conditions (“Terms”) apply to all sales of goods, provision of services, and use of the website by Supamaxx Australia Pty Ltd (ABN 92 157 749 374), trading as Supamaxx™ or MAXXIS Group (“Supamaxx”, “we”, “our” or “us”). Definitions
Company refers to Supamaxx Australia Pty Ltd trading as MAXXIS Group.
Client refers to any person or entity placing an order or requesting a quote.
Work refers to the product supply, installation, or services provided by the Company.

1. Acceptance of Terms
By placing an order, requesting a quote, or using this Website, you accept and agree to be bound by these Terms. Any inconsistent conditions submitted by you in a purchase order, tender, or other form will not be binding unless explicitly agreed to in writing.

Quotes, Orders & Payment
5. Quotes & Offers
All pricing, quotes, and information on this Website or provided through email, in-person, or by phone are an invitation to treat only and not a binding offer. All orders are subject to acceptance by Supamaxx.
Quotes remain valid for 30 days unless otherwise stated.
Pricing is based on the specifications at time of quotation. Any change in scope, site conditions, or delays caused by the Client may result in a variation.
Written approval is required for all variations before additional Work proceeds.
6. Pricing, Rates & Site Inspections
All prices are in Australian Dollars (AUD) and exclude GST unless stated otherwise. Full payment is required before dispatch unless otherwise agreed. We may invoice for partial deliveries.
Where applicable, we will attend site to determine required specifications. If not possible, we reserve the right to charge based on hourly labour rates or pre-defined quantities.
7. Payment Methods and Terms
Supamaxx accepts payment via Visa, Mastercard, EFTPOS, and direct bank transfer. Orders will not be processed until full payment has cleared. Where applicable, credit card surcharges may apply.
Unless otherwise agreed, payment is due prior to dispatch of goods or commencement of installation.
Approved trade accounts must settle invoices within 30 days of issue.
We reserve the right to charge interest on overdue amounts at a rate of 2% per month.
Payment methods include EFT, credit card, or cheque. Goods will not be released until funds are cleared and remittance has been received.
Product Representation
8. Accuracy of Product Information
While we strive for accuracy, images and descriptions may vary slightly from the delivered product due to manufacturing changes. You will be notified of any substitutes prior to order fulfilment.
Standards Compliance
9. Compliance
Supamaxx products are designed to meet Australian Standards where stated. However, we are not responsible for compliance failures due to incorrect installation or misuse. Proper installation and maintenance in accordance with our guidelines are essential.
Title, Risk & Delivery
10. Title, Risk and Site Responsibility
Ownership of goods remains with Supamaxx until full payment is received.
In the case of dishonoured payments, we reserve the right to retrieve installed products from site without notice.
Once products are commissioned and in use, full payment is immediately due.
The Client is responsible for clearly marking installation locations and locating all underground services within 1.5m of proposed works.
We are not liable for damage to services not identified or disclosed.
Water, power, toilet facilities, and vehicle access must be made available to our personnel unless otherwise arranged.
11. Delivery Times
Risk transfers to the Client upon delivery or installation, whichever occurs first.
Dispatch is typically within 1–3 business days for in-stock items. Estimated delivery times are:
VIC Metro: 1–2 business days
NSW, SA, QLD, ACT: 3–5 business days
TAS, WA, NT: 5–10 business days
Delays outside our control may occur. If an item is backordered, you’ll be notified with options to cancel or wait.
Warranties & Returns
12. Warranty, Standards & Product Use
A 12-month warranty applies to materials and labour unless stated otherwise.
Warranty does not cover vandalism, improper installation by third parties, or misuse.

Products are manufactured to meet relevant Australian Standards where stated.
Supamaxx is not liable for incorrect installation, misuse, or non-compliant application.

13. Change of Mind
Due to custom manufacturing, we do not accept returns or issue refunds for change of mind.

Limitation of Liability

General Terms
Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable under any applicable law, that provision will be deemed severed from the Terms and the remaining provisions will continue in full force and effect.Waiver
No waiver by Supamaxx™ of any breach or default shall be deemed a waiver of any preceding or subsequent breach or default. Any waiver must be in writing and signed by an authorised representative of Supamaxx™.Assignment
